One of the dangerous product cases we handled involved a contractor who was killed while operating a hand-held grinder. While the grinder had a guard, the guard was removable and did not have a warning about the importance of not removing it. After a co-worker removed the guard, our client's husband began using the grinder. Suddenly, a piece of the grinding disc fractured off while our client was using it. The wheel shot back and hit him in the head, with the force of a bullet, killing him. This wrongful death case also involved liability on the part of the employer, who knew that employees were operating the grinders without guards and had in fact, encouraged them to do so because they felt the guards slowed workers down, as well as liability on the part of the contractor who knew that the guards were being removed.

Railroad Accidents

Railroad crossing accidents happen on a regular basis in Texas, especially in rural counties where many crossings are unprotected by gates. In one of the cases handled by our firm, our client could not see the train approaching because her view had been blocked by railroad cars parked on a side track. The law in Texas, as well as railroad operating regulations, is to keep parked boxcars at least 250 feet from unprotected crossings. The cars in this case had been parked less than 100 feet from the crossing.
